Definition Ticaret Borsaları - Commodity Exchanges 

Commodity Exchanges are corporate bodies that are established to buy and sell the products within the quotation of the exchange, to determine, register and announce the prices that are settled in the exchange in accordance with the Law No. 5174.

 Kuruluşu – Establishment 

Exchanges are establishes where the commercial needs require, by the Ministry. Special exchanges will be establishes to operate nationally, regionally or internationally.

 

For the regional exchanges to be established, more than half of the regional producers should make written application to the Association. Or, it can be formed with the approval of the Ministry with the decision of 2/3 of the members of the assemblies of each exchange in addition to the approval of the Association. When the regional exchanges are establishes, the founder exchanges become branches.

 

National and regional exchanges are subject to the legal provisions that apply to the commodity exchanges.

 

The exchanges must provide suitable and sufficient organization, substructure, equipment and personnel for the services that will be given in accordance with the criteria determined by the ministry.

 

Classification of the exchanges will be made by the Ministry with a regulation, upon the approval of the Association.

 

People residing in a foreign country will make operations in international exchanges.  

Çalışma Alanı - Areas of Interest

The area of interest for the exchange is region where it is located. This area will be enlarged to include the neighbouring cities with the decision of Executive Board until exchanges are established in those cities.

 Görevleri – Duties

1.      Arranging and registering buying and selling process of the products within the quotation of the exchange.

2.      Determining and announcing the daily prices of the products within the quotation of the exchange.

3.      Making general arrangements to determine the delivery and payment obligations of buyer and seller, settlement conditions, conditions effective on prices and arbitration procedures in case of disagreement.

4.      Following up domestic and foreign exchanges and informing about the prices, guiding its members in terms of e-commerce and –internet networks.

5.      Arranging and certifying the documents in Article 51.

6.      Forming laboratories and technical offices to determine the types and qualifications of products within the quotation of the exchange or participate in the already founded ones.

7.      Determining the uses and customs, and conventions regarding the exchange, presenting for the approval of the Ministry and announcing.

8.      Making proposals, demands and applications to governmental offices on subjects concerning the exchange; filing a claim on behalf of itself or its members for the benefit of all or some of its members.

9.      Following applications that would damage competition and inform the relevant offices when determined.

10.  Executing the duties, which are given to ministries or other governmental institutions with the law, if they are given to the exchange within the framework of its foundation aims and responsibilities.

11.  Giving the documents that are required by the members and providing the necessary service related to them.

12.  Evaluating the applications about domestic fairs and making proposals to the association.
